Not every option is available for every property. The structures below are examples of how a transaction can be arranged. Which ones may apply depends on the property, your goals, financing, title, market conditions, due diligence, and other transaction factors. No repairs or clean-out requiredIn some situations, an owner prefers to receive payments over time rather than a single lump sum. With seller financing, the owner effectively acts as the lender, which can offer flexibility around timing and how proceeds are received. Whether this fits depends on the property and your goals, and you should review any structure with your own tax and legal advisors.
Payments over time, when it fitsIn a subject-to arrangement, a property is acquired while its existing financing stays in place. This can be relevant in specific situations, but it involves important considerations for all parties and is not appropriate for every property. We explain the details clearly and encourage independent advice before proceeding.
Existing financing stays in placeA novation replaces or restructures the terms of an existing agreement with the consent of the parties involved. In real estate, this approach can help improve a property before a sale under a defined agreement. It is a more specialized structure that only applies in certain circumstances.
A restructured agreement, in select casesAn option gives a defined period to move toward a purchase under agreed terms.
